1. Introduction

Welcome to 1UP Collaborative Gaming™ ("we", "us", "our"). By using our website and services, you agree to comply with and be bound by the following terms and conditions ("Terms"). Please review these Terms carefully. If you do not agree with these Terms, you should not use our website or services.

2. Services

1UP Collaborative Gaming™ provides online collaborative gaming sessions designed to support neurodiverse individuals. Our services are tailored to enhance social skills, teamwork, and personal growth.

3. Eligibility

Our services are available to individuals with NDIS funding as well as private pay clients. You must be at least 18 years old to register for our services, or have parental consent if you are under 18.

4. Registration and Account

To access certain services, you may need to register an account. You agree to provide accurate and complete information during the registration process and to update such information to keep it accurate and complete. You are responsible for maintaining the confidentiality of your account login information and for all activities that occur under your account.

6. Cancellation Policy

Cancellations must be made at least 48 hours in advance to avoid a fee. Cancellations with less than 48 hours' notice will incur a full session fee.

7. Rescheduling Policy

Rescheduling must be done at least 48 hours before the session. If rescheduled within 48 hours but within the same week, a 50% session fee applies. If rescheduled within 48 hours and beyond the same week, a 100% session fee will be charged.

8. No-Show and Late Arrival Policy

Clients who do not attend their scheduled session without prior notice will be charged the full session fee. Arriving 15 minutes or more late is considered a no-show, and the full session fee applies.

5. Payments and Refunds

Fees for our services are outlined on our website or as agreed upon in your service agreement. Payments must be made in accordance with the payment terms specified. If you have any issues with billing, please contact us immediately. Refunds will be handled on a case-by-case basis and in accordance with applicable laws.

6. Privacy

Your use of our services is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding the collection and handling of your personal information.

7. User Conduct

You agree to use our services only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the services by any third party. You must not:

Engage in any conduct that is unlawful, harmful, or fraudulent.

Use our services to harass, abuse, or harm another person.

Impersonate any person or entity or misrepresent your affiliation with any person or entity.

8. Intellectual Property

All content and materials available on our website, including but not limited to text, graphics, logos, and software, are the property of 1UP Collaborative Gaming™ or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without our prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law, 1UP Collaborative Gaming™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your use or inability to use our services.

Any unauthorized access to or use of our servers and/or any personal information stored therein.

Any interruption or cessation of transmission to or from our services.

You agree to indemnify, defend, and hold harmless 1UP Collaborative Gaming™, its directors, officers, employees, and agents, from and against any and all claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in any way connected with your use of our services or violation of these Terms.

11. Changes to Terms

We may update these Terms from time to time to reflect changes in our practices or legal requirements. The updated Terms will be posted on our website, and we encourage you to review them periodically.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
